Terms of Service

These Terms govern use of MarkApprove, a client approval ledger and milestone invoice-readiness service for freelancers and small teams. By creating an account, using MarkApprove, or submitting feedback through a review link, you agree to these Terms.

Operator

The service is operated by MarkApprove. References to MarkApprove, we, us, and our mean the operator of the MarkApprove service. Account, service, and policy questions should be sent to the contact paths listed below.

Not Legal Advice

MarkApprove helps record client feedback, milestone approvals, and invoice-readiness status, but it does not provide legal advice, contract advice, intellectual property clearance, tax advice, accounting services, or professional design approval standards. Approval records may be useful business records, but you are responsible for deciding what they mean for your client relationships, invoices, and contracts.

Accounts

You must provide accurate account information, keep your password secure, and promptly notify us of unauthorized access. You are responsible for activity under your account and for the review links you create.

Customer Content

You keep whatever rights you have in the content you upload or submit. You give MarkApprove permission to host, process, transmit, display, and store that content only as needed to provide and support the service. You represent that you have the rights and permissions needed to upload and share the content.

Intellectual Property And Takedown Requests

You are responsible for making sure uploaded deliverables, client assets, brand materials, comments, and related files do not infringe another person's rights. If you believe content in MarkApprove infringes your rights, contact support@markapprove.com with enough detail for us to identify the content, your claimed rights, your contact information, and a statement that the report is accurate.

We may remove or restrict access to content when we believe it creates legal, security, privacy, or service risk.

Sensitive And Regulated Information

MarkApprove is not intended for medical records, protected health information, payment card numbers, government IDs, highly sensitive personal data, or regulated workloads unless separately agreed in writing. Do not upload those materials to the service.

Review Links And Approvals

Review links may be viewed by anyone who has access to the link unless you use available protections such as access codes, pausing, expiration, or link regeneration. Approvals may record the approver name, email, timestamp, deliverable version, milestone, unresolved comment count, IP address, and browser information. Freelancers are responsible for sharing links only with intended reviewers and confirming the authority of any approver.

Acceptable Use

You may not use MarkApprove to upload, share, or process unlawful, infringing, deceptive, harmful, abusive, hateful, sexually exploitative, malware-related, or privacy-violating content. You may not attempt to bypass security controls, scrape the service, overload infrastructure, reverse engineer non-public parts of the service, interfere with other users, or use MarkApprove to send spam.

Subscriptions And Billing

MarkApprove may offer a Free plan and paid plans such as Starter and Studio. Public plan limits are based primarily on active milestone counts, while upload safety controls and acceptable-use limits still apply. Paid subscriptions are billed through Stripe. Stripe may handle checkout, payment methods, invoices, applicable taxes, subscription management, and cancellations through its hosted portal.

Paid subscriptions renew automatically until canceled. Prices, plan limits, and included features may change for future billing periods. Taxes may be added where required. You are responsible for keeping billing and account information accurate.

Cancellation And Refunds

You may cancel a paid subscription through the billing portal or by contacting billing@markapprove.com. Cancellation stops future subscription renewals, but access may continue until the end of the current billing period unless otherwise stated. Fees already paid are generally non-refundable except where required by law or where MarkApprove chooses to issue a courtesy refund.

After cancellation or account deletion, MarkApprove may retain limited records for security, fraud prevention, tax, accounting, backup, dispute, and legal compliance purposes. Uploaded deliverables and project records may be deleted or made inaccessible according to the Privacy Policy and active retention practices.

Service Changes

MarkApprove may change, suspend, or discontinue features, plans, limits, or integrations. We will try to avoid unnecessary disruption, but we do not guarantee that every feature will always be available.

Disclaimers And Liability

The service is provided as is and as available. MarkApprove does not promise uninterrupted service, error-free operation, legal enforceability of approvals, or that the service will meet every business need.

To the fullest extent allowed by law, MarkApprove will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, or client disputes. MarkApprove's total liability for claims relating to the service is limited to the amount you paid MarkApprove in the three months before the event giving rise to the claim, or $100 if you paid nothing.

Indemnity And Termination

You agree to defend and indemnify MarkApprove from claims arising from your content, your use of the service, your violation of these Terms, or your violation of another person's rights. We may suspend or terminate access for nonpayment, security risk, misuse, legal risk, or violation of these Terms.

Disputes And Notices

Before filing a claim, you agree to contact MarkApprove and give us a reasonable opportunity to resolve the issue informally. These Terms do not limit rights that cannot be waived under applicable law.

Notices from MarkApprove may be sent to the account email address, displayed in the product, or posted on the website. Support and account questions should be sent to support@markapprove.com; billing questions should be sent to billing@markapprove.com.
